- Entrance to the Avalon Airport Bus Zone (Bus Zone) establishes a contract between you and Avalon Airport (contract). The contract is subject to the terms and conditions as set out below (Terms and Conditions). A copy of the Terms and Conditions can also be found at the Avalon Airport website.
- For the purposes of the Terms and Conditions, Avalon Airport includes Avalon Airport Australia Pty Ltd and all associated entities, employees, agents and contractors (Avalon Airport).
- The Terms and Conditions apply to you and your vehicle at all times while within the Bus Zone, including your entrance, use and exit of the Bus Zone. If you do not accept these Terms and Conditions, you must not enter the Bus Zone.
- Entrance to and use of this Bus Zone is at your own risk.
- The Bus Zone is for bus (as defined in the Bus Safety Act 2009) access and use only, and no other vehicles may enter or use the Bus Zone.
- By agreeing to be bound by the Terms and Conditions of this contract, you agree:
- to pay the Avalon Airport Bus Zone Fee prior to, and as a condition of, entering the Bus Zone. The Avalon Airport Bus Zone Fee is determined by the maximum number of passengers that may be safely carried on the bus (as determined in accordance with the Bus Safety Regulations 2010). The Avalon Airport Bus Zone Fee is as specified at the entrance of the Bus Zone and on the Avalon Website, as amended from time to time);
- to park only in the designated passenger collection area, unless otherwise authorised, and only for so long as is necessary to collect one or more passengers;
- to comply with all reasonable and lawful directions given to you by Avalon Airport;
- to drive carefully and responsibly, obeying all speed limits and otherwise complying with all road rules;
- that the information you provide in relation to the maximum number of passengers your bus can carry is true and correct; and
- that the fee payable to enter the Bus Zone is non-refundable, irrespective of whether you collect any passengers.
- The Road Safety Act 1986 (Vic) and other relevant legislation continues to operate once you have entered the Bus Zone. Entrance to the Bus Zone is taken to be confirmation that you are a person licenced to operate the motor vehicle in which you are entering the Bus Zone.
- While Avalon Airport will take all reasonable steps to protect your vehicle while in the Bus Zone, you agree to release Avalon Airport from all liability, to the maximum extent permitted by law, including any loss, damage or injury that occurs to a person or property, regardless of whether the loss, damage or injury is direct, indirect, incidental, consequential or economic arising from entering, using or exiting the Bus Zone, including the collection or dropping off of passengers in the Bus Zone. Avalon Airport waive all liability where loss, damage or injury arises from default, misconduct or otherwise by Avalon Airport. Specifically, Avalon Airport disclaims all liability to you under or in respect of the subject matter of this contract, which includes any claims arising under statute, tort or otherwise, to the maximum extent permitted by law.
- Avalon Airport will not be liable for loss or damage to any valuables left unattended in your vehicle.
