Taxi Rank Terms and Conditions

1. Entrance to the Avalon Airport Taxi Rank (Taxi Rank) establishes a contract between you and Avalon Airport (contract). The contract is subject to the terms and conditions as set out below (Terms and Conditions). A copy of the Terms and Conditions can also be found at the Avalon Airport website.
2. For the purposes of the Terms and Conditions, Avalon Airport includes Avalon Airport Australia Pty Ltd and all associated entities, employees, agents and contractors (Avalon Airport).
3. The Terms and Conditions apply to you and your vehicle at all times while within the Taxi Rank, including your entrance, use and exit of the Taxi Rank. If you do not accept these Terms and Conditions, you must not enter the Taxi Rank.
4. Entrance to and use of the Taxi Rank is at your own risk.
5. By agreeing to be bound by the Terms and Conditions of this contract, you agree:
   1. to pay the Avalon Airport Taxi Rank Fee (as specified at the entrance of the Taxi Rank and on the Avalon Website, as amended from time to time) prior to, and as a condition of, entering the Taxi Rank;
   2. to park only in the designated passenger collection area, unless otherwise authorised, and only for so long as is necessary to collect one or more passengers for the purposes of providing a commercial passenger vehicle service;
   3. to comply with all reasonable and lawful directions given to you by Avalon Airport;
   4. to drive carefully and responsibly, obeying all speed limits and otherwise complying with all road rules; and
   5. that the fee payable to enter the Taxi Rank is non-refundable, irrespective of whether you collect any passengers.

6. The Road Safety Act 1986 (Vic) and other relevant legislation continues to operate once you have entered the Taxi Rank. Entrance to the Taxi Rank is taken to be confirmation by you that you are an accredited driver (as defined in the Commercial Passenger Vehicle Industry Act 2017).
7. While Avalon Airport will take all reasonable steps to protect your vehicle while in the Taxi Rank, you agree to release Avalon Airport from all liability, to the maximum extent permitted by law, including any loss, damage or injury that occurs to a person or property, regardless of whether the loss, damage or injury is direct, indirect, incidental, consequential or economic arising from entering, using or exiting the Taxi Rank, including in connection with the collection or dropping off of passengers in the Taxi Rank. Avalon Airport waive all liability where loss, damage or injury arises from default, misconduct or otherwise by Avalon Airport. Specifically, Avalon Airport disclaims all liability to you under or in respect of the subject matter of this contract, which includes any claims arising under statute, tort or otherwise, to the maximum extent permitted by law.
8. Avalon Airport will not be liable for loss or damage to any valuables left unattended in your vehicle.
